1. Scope of Application

NOREIA Mind e.U. provides its services exclusively on the basis of these Terms and Conditions (T&Cs). Any deviations from these Terms and Conditions shall only be valid if expressly confirmed in writing by NOREIA Mind e.U.

NOREIA Mind e.U. is entitled to perform all or part of the agreed services through qualified employees or independent subcontractors, business partners, or freelance cooperation partners.

Coaching and consulting services are based on a relationship of mutual trust between the client and NOREIA Mind e.U. Coaching is a voluntary, active, and self-directed process. Therefore, no specific outcome or success can be guaranteed. Effective cooperation requires the client’s willingness to engage with their personal circumstances, individual challenges, and current situation.

2. Insurance / Personal Responsibility

The coaching and consulting services provided by NOREIA Mind e.U. do not constitute psychotherapy and are not intended to replace psychological or psychotherapeutic treatment.

Clients are responsible for ensuring that they are in a suitable physical and mental condition to participate in coaching or consulting services. If a client is currently undergoing psychological or psychotherapeutic treatment, this must be disclosed to NOREIA Mind e.U. before the commencement of any services.

Participation in coaching and consulting sessions is entirely voluntary and at the client’s own responsibility.

3. Liability

NOREIA Mind e.U. provides professional services only. No specific result or success is owed or guaranteed.

Any claims for damages are excluded unless they arise from intentional misconduct or gross negligence on the part of NOREIA Mind e.U. Liability for indirect damages, consequential damages, loss of profit, or claims by third parties is excluded.

Participation in coaching and consulting sessions is voluntary and at the participant’s own risk. Each participant is liable for any damage caused by themselves and agrees to indemnify and hold harmless NOREIA Mind e.U. against any third-party claims arising from such conduct.

Clients are responsible for complying with all applicable safety regulations at the respective venue.

NOREIA Mind e.U. accepts no liability for the loss of or damage to personal belongings brought to coaching sessions, workshops, or other events.

4. Confidentiality

NOREIA Mind e.U. undertakes to treat all business-related and personal information obtained during the course of its activities as strictly confidential.

This duty of confidentiality shall remain in force indefinitely unless disclosure is required by law.

5. Appointments and Cancellation Policy

Scheduled coaching and consulting appointments may be rescheduled or cancelled free of charge up to 48 hours before the agreed appointment.

For appointments scheduled on a Monday, cancellations or rescheduling requests must be received no later than 08:00 a.m. on the preceding Friday.

For cancellations received after these deadlines or in the event of non-attendance, NOREIA Mind e.U. reserves the right to charge the full agreed fee.

6. Fees

NOREIA Mind e.U. is entitled to payment of the agreed fee for the services provided.

If the client prevents the execution of an agreed service or terminates the engagement after the contract has been concluded, NOREIA Mind e.U. shall remain entitled to the agreed remuneration.

NOREIA Mind e.U. reserves the right to withhold further services until all outstanding invoices have been paid in full.

Except in the case of obvious defects, complaints regarding the services provided do not entitle the client to withhold payment of any due fees.

7. Payment Terms

Unless otherwise agreed in writing, the following payment terms shall apply:

Services are invoiced after they have been provided. NOREIA Mind e.U. is entitled to issue invoices electronically. By entering into the contractual relationship, the client expressly agrees to receive invoices in electronic form.

All invoices are payable immediately upon receipt without deduction.

In the event of late payment, NOREIA Mind e.U. reserves the right to suspend ongoing work and withdraw from the contract. Any resulting costs, including loss of profit, shall be borne by the client.

Default interest shall be charged at the customary commercial banking rate.

The client is not entitled to withhold payments due to alleged incomplete performance, warranty claims, guarantee claims, or any other objections, nor may the client offset payments against counterclaims.

8. Governing Law and Jurisdiction

All legal relationships between NOREIA Mind e.U. and the client shall be governed exclusively by the laws of the Republic of Austria, excluding the conflict-of-law provisions of private international law.

The competent court in Wiener Neustadt, Austria, shall have exclusive jurisdiction over all disputes arising from or in connection with the contractual relationship, provided this is legally permissible.

By registering for or booking any service provided by NOREIA Mind e.U., the client acknowledges and accepts these Terms and Conditions. It is assumed that the client has read and understood these Terms and Conditions prior to booking.
